Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of digital-fox.net and the website design, hosting and maintenance services provided by Digital Fox (“we”, “us”). By creating an account or buying a plan you agree to these Terms.

1. Our services

We design, build, host and maintain websites and related services as described on our pricing page and in your order. Features and limits of each plan are shown at the time of purchase.

2. Your account

You must provide accurate information and keep your login details secure. You are responsible for all activity under your account. You must be at least 18 years old or have legal capacity to enter a contract for your business.

3. Plans, billing and renewal

• Plans are billed in advance, monthly or yearly, as you choose at checkout.
• Payments are processed securely by Stripe. By buying, you authorize us and Stripe to charge your chosen payment method.
• Subscriptions renew automatically at the end of each period until you cancel.
• Prices exclude taxes unless stated. You are responsible for any applicable taxes.
• If a payment fails, we may retry it, suspend your services, and end your plan if it stays unpaid.
• We may change prices with at least 30 days’ notice. The new price applies from your next renewal.

4. Cancellation and refunds

You can cancel at any time from your account. Cancellation takes effect at the end of the current paid period, and you keep access until then. If you are not satisfied, you may ask for a refund of your first payment within 14 days of purchase. After that, payments are non-refundable except where the law requires otherwise.

5. Your content and responsibilities

You keep ownership of your brand, text, images and other content (“Client Content”). You give us permission to use it only to provide the services. You confirm that you have the rights to everything you give us and that it is lawful.

6. Acceptable use

You may not use our services for anything illegal, to infringe other people’s rights, to distribute malware or spam, to harass others, or to harm the security or performance of our systems. We may remove content or suspend a site that breaks these rules.

7. Our intellectual property

We keep all rights in our software, themes, templates, designs and documentation, except for third-party and open-source components, which are licensed under their own terms. Your use of our software is also governed by the Software License Agreement.

8. Third-party services

Our services may rely on third parties such as Stripe, hosting providers and domain registrars. We are not responsible for their services, but we choose them with care.

9. Availability and support

We aim to keep your website available and secure, but we cannot guarantee uninterrupted service. Support is provided by email at support@digital-fox.net during normal business days.

10. Suspension and termination

We may suspend or end your services if you break these Terms, do not pay, or if the law requires it. We will give notice where reasonably possible. On termination, you may request a copy of your Client Content within 30 days.

11. Disclaimers

Our services are provided “as is” and “as available”. To the fullest extent allowed by law, we do not give any warranties beyond those that cannot be excluded, including any promise of specific traffic, sales or search ranking results.

12. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect or consequential losses, loss of profit, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to cover claims and costs arising from your Client Content or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of [Country or state]. Disputes will be handled by the courts of that place, unless mandatory consumer law gives you other rights.

15. Changes to these Terms

We may update these Terms. The date at the top shows when they last changed. Continued use after a change means you accept the new Terms.
